FMLA/Non-FMLA

The Family and Medical Leave Act (FMLA) provides certain employees with up to 12 weeks of unpaid, job-protected leave per year. FMLA is designed to help employees balance their work and family responsibilities by allowing them to take reasonable unpaid leave for certain family and medical reasons.

Catastrophic Sick Leave Bank Program

The Catastrophic Sick Leave Bank (CSLB) is a pool of sick leave and annual leave voluntarily donated by individuals who are employed full-time on an annual salary basis for potential use as sick leave by eligible full-time employees who are also donors to the bank.

Eligible recipients may receive up to 90 days of paid CSLB leave in any one program year (September 1 – August 31). CSLB leave may be approved in increments not to exceed one month.  The Catastrophic Sick Leave Bank will be administered centrally by the University’s Office of Human Resources Management.

Dedicated Sick Leave Program

The Dedicated Sick Leave Program enables individuals who are employed full-time on an annual salary basis to donate sick leave and/or annual leave for use as sick leave by a seriously ill or injured eligible employee who has been designated by the donor.

Eligible recipients may receive up to 120 days or 6 months of paid sick leave, whichever is greater, in any one program year (September 1 – August 31), inclusive of the annual leave period for teaching faculty. Donated leave may be approved in increments not exceeding two months. The Dedicated Sick Leave Program permits donations of annual leave and/or sick leave across campuses and across titles.

Parental Leave 

FMLA

Apply for the Family and Medical Leave Act (FMLA). If eligible, as the employee and birth mother, they may be able to use your sick time which can be up to 6 weeks if a normal delivery, or up to 8 weeks if a caesarean delivery for post-partum leave. HR must be informed of the date of delivery as soon as possible. 

Note that childbirth, adoption, or foster placement is a qualifying event. The dependent can be added to an employee’s existing health insurance within 30 days of this event. 

After FMLA, PSC-represented employees would be eligible for Paid Parental Leave. All other employee staff titles may consider applying for Paid Family Leave within 1 year of the child’s birth, adoption or foster placement. Paid Family Leave (PFL) is an employee-funded insurance policy provides job protected, paid time off to bond with a newly born, adopted, or fostered child for up to 12 weeks at 67% of your average weekly wage, up to a cap.

Paid Parental Leave (PPL): Full-Time Instructional/Non-Instructional Staff

Full-time PSC-represented employees with a minimum of one year of service are entitled to a leave of absence with full pay to care for a newborn, or newly adopted child up to one year of age, for up to 8 weeks of paid leave. Paid parental leave must be taken immediately upon the birth or adoption of the child. Substitutes who do not have an underlying regular annual appointment are not eligible for this leave.

The employee must give notice of intent to take paid parental leave to their department chair or unit head and to the Director of Human Resources at least three months prior to the proposed date of the leave or when the employee has knowledge of the impending birth or adoption, whichever occurs later.

As with other paid leaves, the period during which the employee is on paid parental leave will count as service. Paid parental leave taken pursuant to this program will run concurrently with Family Medical Leave Act (FMLA) leave and the unpaid parental leave provided below, to the extent that such leave is available to the employee.

NYS Paid Parental Leave for ECP and CSM Staff

Employees may take leave with full pay for up to 12 weeks for each qualifying event, defined as the birth of a child or placement of a child for adoption or foster care. NYS PPL is available for use once every 12-month period.  A qualifying event begins the 12-month period.

Time on NYS PPL must be completed within 7 months from the qualifying event. NYS PPL may not be used intermittently and must be taken in a single block of time.

NYS PPL will run concurrently with FMLA, if available.  An employee who gives birth may take up to 6 weeks of FMLA using sick leave accruals and then begin 12 weeks of NYS PPL thereafter.

NYS PPL cannot be used at the same time as Paid Family Leave (PFL) or other accrued leaves.

NYS CMS and ECP Paid Parental Leave

New York State Paid Family Leave (NYS PFL)

New York State Paid Family Leave Benefits (PFL) are available for staff through Collective Bargaining Agreements.  PFL is an employee-funded insurance policy that provides job protected, paid time-off to: 

  • Bond with a newly born, adopted or fostered child;
  • Care for a family member with a serious health condition; or
  • Assist loved ones when a family member is deployed in a foreign country on active military service.

Eligible employees who work at Senior Colleges (on New York State Payroll) are covered under a PFL Insurance Policy provided by the Standard. PFL may entitle employees to take up to 12 weeks of leave.
